Polycom Maintenance Agreement

one. Unless otherwise stated in these Terms and Conditions, these Terms and Conditions may only be amended by a written agreement duly signed by the authorized representatives of both parties, and derogations from the provisions of these Terms and Conditions in an order or other written notification have no effect. (ii) repair or repair of damage or defects of the polyproduct resulting from external causes of the polyproduct, including disasters, fires, accidents, negligence, abuse, vandalism, water, electric shocks, lightning or installation site failures, in order to meet polyanalysisable specifications; or resulting from the use of the polyproduct for purposes other than those intended; or the use of the poly product with items that have not been delivered or approved by Poly; or resulting from the maintenance or attempted repair of a polyproduct object by persons other than poly agents or persons authorized by Poly; “poly-products”: poly-branded products and/or product families that are generally available on the market. “Service descriptions” refer to poly service program offerings defined by poly service descriptions and generally available through Poly Connect. c. If a provision of these Terms and Conditions is declared invalid, illegal or unenforceable, the other terms of these Terms and Conditions will not be affected or affected. B. Time on duty. For service descriptions covering a poly product for a given period (the “period of service”), the service period is the 12-month period of service (or the other period indicated in an order accepted by Poly), from the date Poly accepts the customer`s order (or another date indicated in the service description) for the service description. “Upgrade” means new versions of the software, which contains improvements to improve the functionality or capabilities of the software that Poly typically makes available to its support customers. Upgrades do not contain major f-versions. The customer is solely responsible for backing up the customer`s data. Poly is under no circumstances required to back up customer data or recover data lost as a result of Poly`s service delivery or otherwise.
